Domain Name Disclosure Policy for the .TATAR Domain

1. General provisions

1.1. This Policy defines the procedure, conditions, and grounds under which the Limited Liability Company “Coordination Center of the Regional Domain of the Republic of Tatarstan” (hereinafter referred to as the Registry) and accredited registrars may provide third parties with information about domain names in the .TATAR domain in connection with a request for disclosure of information (hereinafter referred to as the Request).

1.2. This Policy is drafted in accordance with Section 10 of the ICANN Registration Data Policy, as well as the requirements of the legislation of the Russian Federation, including Federal Law No. 152-FZ dated July 27, 2006 “On Personal Data” and Federal Law No. 149-FZ dated July 27, 2006 “On Information, Information Technologies, and Information Protection.”

2. Form and content of the Request

2.1. The Request shall be submitted in writing via email to: info@dottatar.ru.

2.2. The Request must include the following:

  • Information about the applicant, including the full name of the individual or the name of the legal entity, as well as documents confirming the authority of the applicant’s representative (if applicable);
  • Specification of the domain name in the .TATAR domain for which information is requested;
  • List of requested information;
  • Legal justification for the necessity of the Request, indicating the reason and the applicant’s legitimate interest in the requested information;
  • The applicant’s assurance that the Request is submitted in good faith, that is, without the intent to cause harm, misuse the obtained information, or violate the rights and legitimate interests of the registrant, and that the Request does not contain knowingly false or misleading information.

2.3. Requests that do not contain the above information will not be considered.

3. Processing timeline for the Request

3.1. The Registry and/or registrar shall confirm receipt of a Request that complies with the established requirements of this Policy no later than 2 (two) business days from the date of receipt.

3.2. The Registry and/or registrar may request additional information from the applicant if the provided information is insufficient to make a decision regarding the disclosure of domain name information. The Request is considered received by the Registry and/or registrar from the moment the Request is received, provided it complies with the form and content specified in Section 2 of this Policy. Confirmation of receipt of the Request is sent to the applicant by the Registry and/or registrar only after receiving the complete set of necessary information and supporting documents in accordance with the requirements of this Policy.

3.3. A response to the Request shall be sent to the applicant no later than 30 (thirty) calendar days from the date of confirmation of receipt of the Request in accordance with Section 3.1 of this Policy, except in cases of force majeure. In such cases, the deadline for responding to the Request is extended for the duration of the force majeure circumstances.

4. Decision on the Request

4.1. The decision to provide information in response to the applicant’s Request shall be made by the Registry and/or registrar taking into account the following criteria:

  • Existence of a legal basis for the Request;
  • Sufficiency of the provided justifications and documents;
  • Principle of proportionality and disclosure of only the minimum necessary amount of information;
  • Compliance with the requirements of legislation on personal data and information protection;
  • Absence of signs of abuse of the right to submit a Request;
  • Good faith of the applicant;
  • Receipt of the applicant’s assurances regarding the legality of the use of the obtained information.

4.2. Based on the review of the Request, the Registry and/or registrar may make one of the following decisions:

4.2.1. Fully satisfy the Request;

4.2.2. Partially satisfy the Request;

4.2.3. Refuse to provide the requested information.

4.3. In cases of partial satisfaction of the Request or complete refusal to provide information, the Registry and/or registrar shall provide the rationale for the decision.

5. Confidentiality of information

5.1. All received Requests, documents, and decisions related to them shall be stored in the archives of the Registry and/or registrar and shall not be disclosed, except in cases established by ICANN documents and the legislation of the Russian Federation.

5.2. Information about domain names with restricted access is subject to confidentiality requirements under Federal Law No. 149 dated July 27, 2006 “On Information, Information Technologies, and Information Protection.” Such data may not be disclosed to third parties without the consent of the information holder, except in cases provided for by the legislation of the Russian Federation.

5.3. Personal data of individuals shall not be disclosed to third parties, except on grounds provided for by the legislation of the Russian Federation. Such data may not be provided to third parties in full in the absence of legal grounds for their processing, as stipulated by Article 6 of Federal Law No. 152-FZ dated July 27, 2006 “On Personal Data.” Any person who gains access to personal data shall not disclose or disseminate such information to third parties without the consent of the personal data subject, unless otherwise provided for by the legislation of the Russian Federation.

6. Final provisions

6.1. This Policy is an annex (an integral part) to the Rules for Registration and Terms of Use of Domain Names in the .TATAR Domain.

6.2. The procedure and conditions for amending, supplementing, updating, adopting a new version of this Policy, or its cancellation are established in the Rules for Registration and Terms of Use of Domain Names in the .TATAR Domain.
