1. Introduction


This sunrise registration policy of domain names for other categories of applicants under the .TATAR top level domain (hereinafter the Policy) defines the entities that shall be entitled to priority domain name registration services, as well as the procedure and conditions for receiving such services.


2. Terms used in this document


2.1. Terms and Conditions: .TATAR Terms and Conditions of Domain Name Registrations (the effective version of which is available on the official Registry Operator’s website at: http://domain.tatar.)


2.2. Sunrise registration (of a domain name): registration of second level domains by applicants defined by the terms and conditions established in the present Policy, rather than in accordance with the first come first served principle and prior to the beginning of the open (for all prospective applicants) domains registration in accordance solely with the conditions set forth by this Policy.


2.3. Trademark (service mark), TM: distinctive appellation used to individualize and distinguish between identical and similar products, goods, works and/or services offered by different manufacturers or suppliers of such products, goods, works or services.


Trademarks (service marks) do not include:

  • Trademark applications;
  • Certification and signs of guarantees.

2.4. TM verbal appellation: words, sequences of letters of word-like nature, word combinations, sentences, other linguistic units and their combinations that forms the Trademark.


2.5. TM Owner: Owner of the exclusive right to a Trademark (service mark).


2.6. Mass media organization, Media organization: a periodical printed product or a network resource, TV channel, radio channel, TV program, radio program, video program, film or any other format of dissemination of mass information operating under a permanent name (title).


2.7. The Media Law: Law of the Russian Federation “On Mass Media” No. 2124-1 of December 27, 1991.


2.8. Non-profit organization: any non-for-the-profit entity regardless of its legal status ( foundation, non-profit association, community, etc., per the Federal Law of the Russian Federation “On Non-Profit Organizations”, including any public associations such as public/religious organizations, movements, public foundations, public institution, public activity body, political party, and or non-commercial alliances (associations), including foreign non-government organizations whose activities are not prohibited in Russia.


2.9. Auction Rules: document that describes rules and procedures of conduct of domain name auctions (the effective version hereof posted on the official Registry Operator’s website at: http://domain.tatar.


2.10. Other terms, acronyms and abbreviations used in this Policy shall be construed as defined in the way that they are defined in the Terms and Conditions or Appendices thereof.


3. General provisions and requirements


3.1. Sunrise registration services shall be rendered by virtue of and in compliance with the Terms and Conditions, this Policy, other appendices to the Terms and Conditions, the registration agreement and other applicable documents.


3.2. Registrars can apply for sunrise registration of domain names during these periods: Registrars can apply for sunrise registration of domain names during this period:

  • Start date and time: December 1, 2014 (12:00 MSK)
  • End date and time: December 22, 2014 (12:00 MSK)

3.3. The Registry Operator has the right to unilaterally change the time and date of the beginning and/or the end of any of the application acceptance periods at any time by posting respective information on its official website no later than 10 (ten) calendar days prior to such a change taking effect. The Registry Operator will not accept and consider any applications submitted after expiration of the deadline. Timelines missed are not subject to extension.


3.4. Sunrise registration of a domain name is possible for the term of registration established in Clause 4.1. of the Terms and Conditions.


3.5. During the first year of registration of the domain name registered in accordance with this Policy there remains effective the ban on performance of the following operations with that domain name: (i) transfer of the domain to another administrator (Clause 5.3. of the Terms and Conditions); and (ii) change of the registrar (Clause 5.4. of the Terms and Conditions).


4. Requirements for applicants


4.1. The right for the sunrise registration of domain names in accordance with this policy is granted exclusively to TM Owners, founders of mass media or non-profit organizations.


4.2. Sunrise registration of a domain name is only possible in the name of a TM owner (or one of the owners of a collectively owned TM), a mass media founder (or one of the founders of the organization), or a non-profit organization.


An entity which has been granted the right to use a TM under a license agreement is not a TM Owner (the right to priority registration is not granted to licensees).


5. Requirements to trademarks (service marks)


5.1. The right to sunrise registration of domain names is granted solely to Owner of such trademarks that meet the below requirements:


5.1.1. The trademark (service mark) must have a valid status and be legally protected in Russia.


5.1.2. The legal protection must be provided to this trademark (service mark) only on the basis of:

  • TM registration performed in accordance with the national (per the Russian Civil Code and/or the Paris Convention for the Protection of Industrial Property of March 20, 1883) or an international ( per the Madrid Agreement Concerning the International Registration of Marks of April 14, 1891 and/or the Protocol to the Madrid Agreement of June 28, 1989) procedure; and/or,
  • A decision to recognize the TM as generally known in Russia (Articles 1508 and 1509 of the Russian Civil Code).

Sunrise domain name registration is not provided to the trademarks that were granted temporary protection at official or officially recognized international exhibitions organized in Russia (in accordance with Article 11 of the Paris Convention for the Protection of Industrial Property of March 20, 1883).


5.1.3. A TM that has been registered in accordance with the national or international procedure but which is not generally known in Russia must have a registration date no later than April 24, 2014, or priority date before April 24, 2014, and its period of registration must expire no sooner than January 1, 2015. These limitations do not apply to trademarks that are generally known in Russia.


5.1.4. A TM must include a verbal appellation. The verbal appellation must include no less than one protected element.


6. Requirements to a mass media organization


The right to sunrise registration of domain names in accordance with this Policy is granted exclusively to founders of such Russian mass media organization that meet all the below requirements:

  • The media organization must circulate, inter alia, in Tatarstan (in the media organization’s registration certificate, in the box “Territory of circulation”, there should be reference made to the Republic of Tatarstan );
  • The media organization’s profile and/or specialization must comply with the mission and values of the TLD.TATAR (Clause 2 of the Terms and Conditions);
  • The media organization must be operative;
  • The media organization must be properly registered in accordance with the Law ‘on media” before April 24, 2014.

Sunrise registration of domain names is not granted to foreign media organizations, even where they have been licensed to distribute foreign printed periodicals in the territory of Russian Federation.


7. Requirements to a non-profit organization


The right to sunrise registration of domain names in accordance with this Policy is granted exclusively to such non-profit organizations whose purpose and objectives are in compliance with the mission or values of the TLD.TATAR, i.e. aimed at promotion of the Tatar community’s identity and/or protection of the Tatar historical and cultural legacy.


8. Limitations on the number of domain names


In accordance with this Policy, mass media organizations o and non-profit organizations may register no more than 5 (five) domain names each.


9. Requirements to domain names


9.1.Sunrise registration may be performed solely to such a domain name which


9.1.1. Meets the requirements stipulated in Sub-clauses (а) and (b) of Clause 4.5. of the Terms and Conditions; and,


9.1.2. Either fully replicates, or fully match the verbal appellation of the trademark, or the name (title) of the mass media organization, or the full or abbreviated name (title) of the non-profit organization.


9.2. Meanwhile, where the verbal appellation of the trademark, or the name (title) of the media organization, or the full or abbreviated name (title) of the non-profit organization:


9.2.1. is fully or partially made of non-Latin letters (such as “мушкетер” or "триathlon"), then at the discretion of the applicant in to the applied-for domain name there may be included either an English translation of such words, or their transliteration, or modification of the phonetic script of such words with the use of Latin letters (e.g., “mushketer.tatar” or “musketeer.tatar”, "triathlon.tatar" or “triatlon.tatar”);


9.2.2. ends with the word combination “Republic of Tatarstan” or the word “Tatarstan” in any language (with no regard to declension, such as “Студенты Татарстана”), then the applicant may exclude such a flexion from the applied-for domain name (to apply for a domain name, such as "studenty.tatar" and/or “students.tatar”);


9.2.3. Contains punctuation marks or other characters/symbols (mathematical symbols, the registered trademark symbol, etc.), which in accordance with Sub-clause (b) of Clause 4.5. of the Terms and Conditions may not be included in a domain name (e.g. "Союз молодежи Республики Татарстан", "2 + 2" or "%%игры%%"), then such symbols/characters shall, at the discretion of the applicant, be either replaced with hyphen, or an official term used for such a symbol/character, or omitted/removed from the applied-for domain name (e.g. "souz-molodeji.tatar", "2plus2.tatar" or "games.tatar");


9.2.4. includes a word consisting of symbols/characters which in accordance with Subclause (b) of Clause 4.5. of the Terms and Conditions may not be included in a domain name, but suggest nonetheless an unambigous interpretation of that word’s lexical meaning, (e.g. "соб@к@" or "кла$$ный"), then such symbols/characters may at the applicant’s discretion be either replaced with the Latin-script letters (for example, "dog.tatar" or “sobaka.tatar”; "klassnyj.tatar" or “kla—nyj.tatar”), or or omitted/removed from the applied-for domain name in accordance with Sub-clause 8.2.3. of this Policy.


10. Application procedure for sunrise registration services


10.1. To apply for the sunrise domain name registration service, the applicant, who is a trademark owner, shall:


10.1.1. provide the registrar with all the information, materials, data, references and/or documents required for signing the registration agreement (Clause 3.6.) and sign the registration agreement with the registrar (Clause 3.5. of the Terms and Conditions);


10.1.2. submit to the registrar a sunrise registration application in accordance with the requirements set forth by Clause 11 of this Policy;


10.1.3. provide the registrar with the information, materials, data, reference sand/or documents that prove the applicant and its TM being in compliance with the requirements set forth by Clauses 4 and 5 of this Policy, which may include, but are not limited to:

  • national or international trademark certificate; and/or,
  • decision by a federal executive authority for intellectual property on recognition of the TM as generally known in Russian Federation and on granting legal protection to that generally known TM or a certificate issued for a generally known TM in Russian Federation; and/or,
  • decision by all the owners of a collective trademark to authorize the applicant (one of the owners of such a collective TM) to apply for the domain name registration in their own name (only for collective TMs);
  • a competent court’s effective ruling about recognition of the TM owner’s exclusive right to the protected in Russian Federation TM ;
  • any other details, information, data, documents and/or references about the trademark required by the registrar.

10.2. To apply for the domain name sunrise registration service, the media organization founder (or one of the founders) shall:


10.2.1. provide the registrar with all the information, materials, data, references and/or documents required for signing the registration agreement (Clause 3.6.) and sign the registration agreement with the registrar (Clause 3.5. of the Terms and Conditions);


10.2.2. submit to the registrar a sunrise registration application in accordance with the requirements set forth by Clause 11 of this Policy; and


10.2.3. provide the registrar with the information, materials, data, references and/or documents that prove the applicant and its TM being in compliance with the requirements set forth by Clauses 4 and 5 of this Policy, which may include, but are not limited to State registration certificate for the media organization;


• A decision of all the founders of the media organization to authorize the applicant (one of the founders) to apply for the domain name registration in their own name (where the mass media organizations was founded by several founders);


• A copy of the newspaper/magazine, a recording of the TV show, etc.;


• any other details, information, data, documents and/or references about the media organization required by the registrar.


10.3. To apply for the domain name sunrise registration service the non-profit organization shall:


10.3.1. provide the registrar with all the information, materials, data, references and/or documents required for signing the registration agreement (Clause 3.6.) and sign the registration agreement with the registrar (Clause 3.5. of the Terms and Conditions);


10.3.2. submit to the registrar a sunrise registration application in accordance with the requirements set forth by Clause 11 of this Policy; and,


10.3.3. provide the registrar with the information, materials, data, references and/or documents that prove the applicant and its TM being in compliance with the requirements set forth by Clauses 7 of this Policy, which may include, but are not limited to:


  • The certificate or any other document in evidence of state registration of the non-profit organization;
  • An organization’s charter with the non-profit organization’s mission and corporate object referenced to therein;
  • An authorization to operate as a non-profit organization (for foreign non-profit non-governmental organizations);
  • Any other details, information, data, documents and/or references about the non-profit organization required by the registrar.

10.4. The format, timelines, procedure and method of submission of the application to the registrar and provision the registrar with details, information, data, documents and/or references, as well as ; timelines for acceptance and processing of such applications shall be determined by the registrar.


11. Requirements for sunrise registration application


11.1. An application for sunrise registration should meet all the requirements below (applications that fail to meet at least one of these requirements shall be rejected by the registrar):


11.1.1. All the details, materials, data, information and/or documents that are necessary and sufficient for sunrise registration shall be enclosed in accordance with Clause 10 of this Policy;


11.1.2. The presented details, materials, data, information and/or documents must confirm: (i) the applicant’s compliance with the requirements stipulated in Clause 4 of this Policy; and, (ii) the TM’s compliance with the requirements stipulated in Clause 5 of this Policy, or the media organization’s compliance with the requirements stipulated in Clause 6 of this Policy, or the nonprofit organization’s compliance with the requirements stipulated in Clause 7 of this Policy;


11.1.3. The domain name must meet the requirements stipulated in Clause 9 of this Policy;


11.1.4. The applicant is required to describe the purpose of this domain registration (limited to 150 characters, spaces included), provided that this purpose complies with the Mission and values of the .TATAR TLD (Subclause (d) of Clause 4.5. of the Terms and Conditions).


11.2. A sunrise registration application can be rejected if the registrar (i) does not believe that the purpose of registration does not comply with the Mission or values of the .TATAR TLD and/or (ii) the requested domain name is in conflict with the Mission or values of the .TATAR TLD.


11.3. The registrar shall inform the applicant of the reasons why the application has been rejected.


12. Procedure for processing domain name applications


12.1. All the domain name applications submitted by registrars shall be processed by the Registry Operator within no more than 30 (thirty) calendar days from the end of the application acceptance period.


12.2. If an approved application for sunrise registration of a certain domain name is the only one, the domain name shall be registered before the end of the application processing period specified in Clause 12.1. of this Policy.


12.3. If there are two or more approved applications for the same domain name filed within one phase, the sunrise registration shall be granted to the applicant that meets the following conditions:


12.3.1. If the same domain name is requested by a TM owner and by the founder(s) of a media organization and/or a non-profit organization, the registration shall be granted to the TM owner, while the other application(s), from the mass media organization and/or the non-profit organization, shall be rejected;


12.3.2. If there are two or more applications for the same domain name filed by TM owners, the winner shall be chosen among them through a private bidding organized in compliance with the Auction Rules;


12.3.3. If the same domain name is requested by two or more TM owners, as well as by the founder(s) of a media organization and/or a non-profit organization, the winner shall be chosen among the TM owners through a private bidding organized in compliance with the Auction Rules, while the other application(s) from the mass media organization and/or the non-profit organization shall be rejected;


12.3.4. If the same domain name is requested by the founder(s) of a media organization and/or a non-profit organization, the winner shall be chosen among them in compliance with the Auction Rules.


12.4. During the applications’ processing, the Registry Operator is authorized to request the registrant and/or the registrar for clarifications, details, materials, data, information, documents, etc., to confirm the applicant’s compliance with the requirements stipulated by this Policy. Registrants and registrars must present all the necessary details, materials, data, information, documents, clarifications, etc. to the Registry Operator within 2 (two) working days of the respective emailed request from the Registry Operator.


12.5. A sunrise registration application can be rejected in the following cases:


12.5.1. The Registry Operator shall establish that the applicant did not comply with the requirements stipulated by this Policy as of the time of the application’s processing, and/or the requested domain name does not meet the requirements listed in Clause 9 of this Policy; and/or


12.5.2. The applicant has exceeded the allowed number of requested domain names stipulated in Clause 8 of this policy;


12.5.3. The Registry Operator does not believe that the purpose of registration does not comply with the Mission or values of the .TATAR TLD and/or the requested domain name is in conflict with the Mission or values of the .TATAR TLD; and/or


12.5.4. The Registry Operator has not received the requested clarifications, details, materials, data, information, and/or documents within the term stipulated in Clause 12.4. of this Policy.


12.6. The applicant shall be notified of the rejection (and the reason for rejection) by email within 3 (three) working days.


13. Verification of abidance by this Policy


13.1. The Registry Operator is authorized to perform inspections to verify the registrants’ and their domain names’ compliance with the conditions and requirements listed in this Policy at any time either upon its own decision, or following an objection filed with it in accordance with the .TATAR Dispute Resolution Policy for Sunrise period and Limited Registration periods (Priority Registration periods.


13.2. If the Registry Operator shall establish that a domain name registered during the sunrise period does not comply with this Policy, it shall do the following:


  • Impose a ban on any transfer or reregistration of this registered domain name;
  • If necessary, email a request to the registrant and/or the registrar for clarifications, details, materials, data, information, documents, etc., to confirm the registrant’s entitlement to sunrise registration in accordance with this Policy.

13.3. Registrants and registrars must present all the necessary details, materials, data, information, documents, clarifications, etc., to the Registry Operator within 2 (two) working days of the respective emailed request from the Registry Operator.


13.4. If the Registry Operator does not receive the requested clarifications, details, materials, data, information, documents, etc., within the term stipulated in Clause 9.3. of this policy and/or the Registry Operator does not see these clarifications, details, materials, data, information, documents, etc., as proof of the registrant’s entitlement to sunrise registration, and/or these clarifications, details, materials, data, information, documents, etc., are not sufficient to confirm it, the registration of the domain name in question shall be canceled.


13.5. If the Registry Operator deems the presented clarifications, details, materials, data, information, documents, etc., sufficient to confirm the registrant’s entitlement to sunrise registration, the ban on any transfer or reregistration of this registered domain name shall be lifted.


13.6. The Registry Operator shall notify the registrant and the registrar of any decision taken by email within 3 (three) working days.


14. Final provisions

14.1. This Policy is an appendix (integral part) of the .TATAR Terms and Conditions of Domain Name Registrations.


14.2. This Policy shall come into effect as of the date specified in the head of document and remains in force until a decision of the Registry Operator (to cancel or to terminate this Policy, or a similar decision). However, the termination of this Policy does not relieve any party of obligations that arose before the termination date, or from their responsibility for failure to comply or substandard compliance with this Policy.


14.3. This Policy is subject to change, additions, updates, release of a new edition, or cancellation at any time upon a decision of the Registry Operator. The procedure for and terms of making additions, amendments, and updates, of releasing new editions or cancellation of this Policy are stipulated in the .TATAR Terms and Conditions of Domain Name Registrations.
